HDP says judiciary should not be a partner in crimes of government

The Peoples' Democratic Party (HDP) Co-Vice Chair in charge of Law and Human Rights Commission Ümit Dede and HDP members made a statement in front of the Ankara Courthouse, where the interlocutory hearing of the Kobanê Case has been held. Dede said, “The government could not deal with the HDP politically and is now attempting to prevent all activities of our party by means of law enforcement. Moreover, the government is prompting prosecutors and judges to launch investigations and to carry out conspiracy trials against our party and its members.”

‘JUDICIARY UNDER THE TUTELAGE OF GOVERNMENT’

Recalling the ruling of the European Court of Human Rights (ECtHR) Grand Chamber regarding HDP's former Co-Chair Selahattin Demirtaş, Dede said:

"The ECtHR stated that the trials against opponents were not legal. The opposition members were arrested and tried by the members of the judiciary under the tutelage of the government. Moreover, the ECtHR Grand Chamber stated that the evidence contained in Demirtaş’s file was not in accordance with the law."

CONSTITUTIONAL COURT DECISION

Dede pointed out that the indictment prepared for the HDP's closure case is a "political conspiracy document". He continued, "The Constitutional Court returned the indictment to the Supreme Court of Appeals Chief Public Prosecutor's Office by saying that a lawsuit against the HDP cannot be launched based on the existing evidence in such a document. The leader of the MHP stated that the Constitutional Court decision does not bind them. Inspired by the great partner of the government he continued to say that ‘We will make our counter move, we will finish the job’, and that ‘the Constitutional Court should be closed’.

The supporters of the government are engaging in demagoguery about the decisions of the supreme courts, trying to deceive the people and putting pressure on the judges. However, it should not be forgotten that courts are not places for demagogy, judges and prosecutors cannot say that the decisions of the ECtHR do not bind them. They cannot say that the decisions of the Constitutional Court do not bind them. Therefore, the judges of the Ankara 22nd High Criminal Court should immediately acquit all of our friends and release them and should not be a partner in the crimes of the government which does not recognize the laws.”
