Forensic Medicine Institution ignores prisoners' rights

Kurdistan Workers' Party (PKK) prisoner Hakan Gölünç had received a report from the Kocaeli University Medical Faculty Training and Research Hospital. It stated that Gölünç - diagnosed with brain tumor and a vision loss in the right eye - would see his life in danger under prison conditions.
Ignoring the report of the hospital, the third specialized board of Forensic Medicine Institution of Kocaeli gave a report which said that Gölünç could live on alone and serve his sentence under prison conditions.

Gölünç learned about his brain tumor on 20 September 2012 when he went to see a doctor with complaints of headache.
He received a sentence in a trial against the PKK soon after he underwent a surgery for the removal of the tumor,17.11mm. Difficult days began therewith for Gölünç who was referred from Metris prison in Istanbul to Kandıra F Type Prison No 1 in Kocaeli.

Gölünç first began to suffer epileptic attacks in prison after the surgery, followed by the loss of vision in the right eye-because of the rapidly growing tumor in his brain- and the reduction of vision by 24 percent in the left eye. His health rapidly detoriated when he in additon was denied regular treatment.
His antiepileptic drugs - which he is supposed to take on time and receive in a pillbox - were given to him one by one by the prison administration which also forced him to demand his pills with a petition when the time came. The delayed delivery of drugs has increased the frequency of his epileptic attacks.
Gölünç was not released even after receiving a report from Kocaeli University Medical Faculty Training and Research Hospital which said on 24 April 2013 that the continuation of his imprisonment would lead to critical risks and that his sentence needed to be suspended until the finalization of his treatment.

The Forensic Medicine Institution of Kocaeli later referred Gölünç to neurosurgery department rather than approving the report of the hospital in line with the laws. He was once again diagnosed with brain tumor at the Samatya Research Hospital he was referred to, and at the Marmara University Hospital which said after medical examinations that Gölünç needed to receive radiotherapy before it was too late, and that the repetition of surgery had a risk of death.
The report by Samatya Hospital did not change anything either, as the third specialized board of Forensic Medicine Institution of Kocaeli, led by 'specialist' Sadi Çağdır, reported on 14 August 2013 that Gölünç was "able to maintain his life on his own". The report was also signed by forensic specialist Prof. Dr. İmdat Elmas and neurology specialist Prof. Dr. Abdülkadir Koçer.

Hakan Gölünç who was sent back to Kandıra F Type Prison in September 2013 said the followings in a letter he wrote condemning all that he has been subject to; "It is apparent what the Forensic Medicine Institution aims with this report. They are not going to release us without inflicting a severe harm. Several friends of ours have been released but they already are all facing very critical situations by now. The decisions made by the Forensic Medicine Institutions have nothing to do with medical ethics and are political. The health problems we are suffering cannot be treated and prevented in prison. This is bare torture. I wonder how peaceful these people feel when they go home at night and wake up in the morning. Even the severest tortures end after some time but we do not know when the torture we are suffering is going to end. Me and other sick prisoners will however continue waking up with determination and hope every morning. We will continue smiling as we say good morning to each other. This is because we loved the life as much as we could die for it".
