First three articles need to be amended, says Besarin

KCK Law Committee Member Mordem Besarin spoke to ANF about discussions on the new constitution and how work should be done in drafting the new charter.

Besarin underlines that the new constitution should absolutely reflect the will and opinions of all social actors and notes that a democratic constitution will also play a key role in the solution of the Kurdish problem.

Mordem Besarin points out that the road map followed since the beginning of work on new constitution reveals deficiencies and says that “Instead of a commission of political parties, a commission should be formed with the participation of all social segments, ethnic, religious and civil organizations and institutions. The real will can only be reflected on this basis.” Besarin emphasizes that a constitutional arrangement committee made up of representatives of several political parties alone will not go beyond reflecting issues and desiderata of the people represented by these parties.

Noting that the democratization of the present constitution wouldn’t be possible without the amendment of the first three articles, Besarin said that “The other articles are anti-democratic as a consequence of the first three articles which can’t even be proposed for amendment. This situation constitutes the basis of the present social problems and turning the people into dead bodies. There is a need for a democratic social contract which makes a definition of democracy not subjected to a single language, culture, religion or history reading and expresses a common life where pluralist, free and equal people can live together in solidarity. The constitutional arrangement committee needs to approach on this basis.”

Besarin also points out that all monist, negationist and destructive nation states have fallen down one by one so far and calls attention to a similar situation in Turkey. “A real democratic constitution to reflect the will of all dynamics and colors could only be achieved through the formation of a social consensus”, remarks Besarin and adds the followings;

“The solution of the Kurdish problem will be the basic solvent power of all social problems as the Kurdish issue constitutes the basis of all the issues in Turkey.”
