Turkish court does not recognize the ECtHR decision

Ankara 22nd High Criminal Court has ruled the continuation of detention for 29 politicians who are held hostage within the scope of the Kobanê trial. The court argued that the ECtHR ruling on Selahattin Demirtaş was "not binding".

The first detention examination of 29 politicians who are held hostage within the scope of the "Kobanê indictment" prepared by the Ankara Chief Public Prosecutor's Office and accepted by the Ankara 22nd High Criminal Court was held on February 5.

As a result of the examination, the 22nd High Criminal Court decided to continue the detention of all politicians in the case.

In its reasoned decision, the court board cited the decision of the Grand Chamber of the European Court of Human Rights (ECtHR) for the release Selahattin Demirtaş, former co-chair of the HDP, on December 22, 2020.

"The Court (...) The application made to the Constitutional Court regarding the detention file at our court is still pending. Therefore, the aforementioned decision is not binding for our court since no investigation has been made regarding the file of detention at our court and this has been confirmed by the ECtHR.”

Lawyers of the politicians held hostage will appeal the decision within a week.
