Chile: Free gender identity law implemented

It took Chile five years to finally sign the new regulations which will allow every citizen to chose his/her gender.

After five years of legislative iter and after going through all the complicated legal paths and with the firm and constant opposition of a good part of the governmental bloc, in these weeks, President of Chile, Manuel Piñera has signed the new regulations that establish the freedom of gender choice for all Chileans.

The signature happened in a private act, so to avoid further noise.

The regulation, finally ratified as added to the Constitution, by the Constitutional Court of the southern Latin Americano country, establishes that all people will have the right to choose "their gender identity" based on their self-perception, without the need of undergoing surgery, hormonal treatments or other physical transformations.


The change of name and gender will therefore be a free and voluntary act for people over 18. And for those between 14 and 18, it will be at the request of one of the parents or legal guardians before a Family Court, where the child must be accompanied by a psycho-social support to establish the real determination of the interested person.


The new Chilean regulations that should be in full force by October 2019, also establish that the entire process of gender change must be accompanied by: Decent treatment in procedures, confidentiality regarding name and identity, as well as a superior preservation of the rights of children and their progressive autonomy when it comes to the final decision.
