Family of BÖG (United Forces of Freedom) Commander Aziz Güler (Rasih Kurtuluş), who was martyred in Rojava on September 21, has finally been allowed to get their son's body which had been denied access into Turkey since.
Urfa governor and Suruç district governor had rejected the application of Güler family last month in line with a decision of the Council of Ministers which didn't allow the transfer into Turkey of bodies of any fighters fallen in Rojava. Governor of Suruç had also mentioned a political instruction rather than a legal obstacle for the denial of permission to the delivery of the bodies from Rojava to Turkey.
The Constitutional Court of Turkey had also rejected the family's application without putting forward any reason justifying their decision, but only highlighting an argument that the denial didn't abuse the moral and material unity of the family.
Güler's family also applied to the ECtHR to demand cautionary judgment, enable the delivery of their son's body into Turkey and disallow this injustice by the Turkish state. They on the other hand continued talks with government officials through political representatives.
The ceaseless effort of the family could achieve a result 59 days later, during which Güler's body was held in the morgue of the Roj Hospital in Serêkaniyê city of the Cizîr Canton.
The family took their son's coffin through Mürşitpınar Border Gate, from which it was taken to the Forensic Medicine Institution in Urfa. Following a post-mortem examination here, Güler's body was taken to the morgue of Mehmet Akif İnan Training and Research Hospital, which is again in Urfa.
It is reported the family will take their son's body to Istanbul where he will be laid to rest after two months of torture following his death.
