State of Emergency: out through the door, in from the window

A new law proposal will leave OHAL in place.

The State of Emergency (OHAL) will be lifted on Wednesday but a new law proposal to maintain the OHAL is being prepared.

According to this, the detention review which should be examined within 30 days of the request for release was extended to 90 days.

One of the most prominent legislative proposals to be brought to the General Assembly this week is the detention review as per Code of Criminal Procedure.

Peoples’ Democratic Party (HDP) co-chair Selahattin Demirtas, who has been held hostage in Edirne F Type Prison since 4 November 2016, had lost his case on his detention because the review was not carried out before the established 30 days.

The custody period is up to 12 days when charges are inscribed in the Anti-Terror Law and organized crime.

Thus, release requests can be lodged on file with a review of detention at the latest within period of 30 days.
